Terms of Service
Decision Point Healthcare Solutions ("DPHS") operates the Member Profile and Opus web applications (together the "Platforms") on behalf of its clients and its client's subsidiaries (together the "Organization"). Organization is a customer of DPHS and is responsible for creating and maintaining the information accessible by the Service.
Only authorized employees of the Organization who are at least 18 years of age may access and use these Platforms ("Users"). By logging into the Platforms, you state that you are an employee of the Organization and an authorized User of the Platforms, and you indicate your acceptance of and agreement to all the terms and conditions of this agreement. DPHS or the Organization may terminate your access to these Platforms at any time and will terminate your access if you violate any of these terms and conditions.
The Platforms provide access to Protected Health Information ("PHI") as that term is used under the Health Insurance Portability and Accountability Act of 1996, and associated regulations, as may be amended from time to time ("HIPAA"). The Platforms include numerous data security measures designed to protect PHI from unauthorized access. You agree not to attempt to override, bypass, or defeat any data security measure of these Platforms. You agree not to use the Platforms in a manner that delays, impairs, or interferes with system functionality for others or that compromises the security or integrity of any data, equipment, software, or system input or output.
You agree not to extract or modify, or attempt to extract or modify, information in the Platforms using technology or automated methods such as those commonly referred to as "web scraping", "data scraping", or "screen scraping". You agree not to save, download, or cache any PHI by any method other than by such tools and interfaces as are provided by the Platforms themselves or intrinsic to the operation of a standard web browser program.
You agree to follow the HIPAA policies and procedures established by the Organization for the correct and compliant use of these Platforms. You acknowledge that any improper access or use of the Platforms can result in personal liability and penalties under HIPAA.
You are required to create a passphrase for your account, unless otherwise authenticated through the Platforms' Single Sign ON capability. If authenticating using a passphrase, you agree to create a strong passphrase as required by the Organization's HIPAA policies and you agree to keep this passphrase confidential and to safeguard it and not share it with any person, other than those specifically authorized by the Organization's HIPAA policies. You may store your passphrase in a secure, access-controlled, encrypted passphrase manager, subject to the Organization's policies and procedures.
- Require a minimum length of at least eight characters.
- Contain both numeric and alphabetic characters.
- New passphrases shall not be the same as any previous passphrases used.
DPHS is not a health plan or healthcare provider and it cannot and does not independently review or verify the medical accuracy or completeness the medical information accessible from the Platforms. Use of and access to the Platforms, including, but not limited to, clinical information in the Platforms, is at the sole risk and responsibility of the User or the Organization. DPHS shall not be liable for any action or inaction of User which may give rise to liability under the federal False Claims Act or any state version thereof.
